By accessing or using our website at bracketnova.com and all associated services, features, content, and applications offered by BracketNova (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and BracketNova regarding your use of the Service. You represent and warrant that you have the legal capacity to enter into this agreement.

BracketNova provides a free online platform for users to generate and submit predictions for the NCAA Division I Men's Basketball Tournament ("March Madness"). The Service includes:

3. User Accounts & Responsibilities

Account Creation

To use certain features of the Service, you must register and create an account. When creating an account, you agree to:

• Not share your account credentials with others

You agree not to engage in any of the following prohibited activities:

Multiple Accounts

Creating multiple accounts to gain unfair advantages, including but not limited to:

• Obtaining additional welcome bonuses
• Inflating referral counts
• Manipulating leaderboard rankings
• Circumventing rate limits or restrictions

Automated Systems (Botting)

Using automated systems, bots, scripts, or other unauthorized means to:

• Generate brackets automatically
• Watch advertisements without human interaction
• Create accounts or verify emails
• Access the Service in any unauthorized manner

Other Prohibited Activities

• Attempting to probe, scan, or test the vulnerability of our systems
• Interfering with or disrupting the Service or servers
• Using the Service for any unlawful purpose
• Impersonating any person or entity
• Collecting personal information about other users
• Transmitting viruses, malware, or other harmful code
• Reverse engineering or attempting to extract source code from the Service
• Selling, trading, or transferring your account to others

The Service and its original content, features, and functionality are owned by BracketNova and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes, but is not limited to:

• The BracketNova name, logo, and branding
• Website design and user interface
• Original software and algorithms
• Text, graphics, and other content

Your License to Us

By submitting brackets or other content through the Service, you grant BracketNova a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with the Service.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of results

BracketNova does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no guarantees about the accuracy of tournament data or bracket scoring.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRACKETNOVA SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Any unauthorized access to or alteration of your data
• Any third-party conduct or content on the Service

In no event shall BracketNova's total liability exceed the amount you paid to BracketNova in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

8. Indemnification

You agree to defend, indemnify, and hold harmless BracketNova and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your conduct in connection with the Service

9. Changes to Terms

BracketNova reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
